delivery comes with a two (2) year warranty.

MHC Construction provides all consumer customers with an additional two (2) year warranty for the stone house frame installation delivery.
This warranty complements the rights and conditions under consumer protection law and does not limit the customer’s statutory rights related to legal defect liability.

Warranty Extends Defect Liability

Warranty and defect liability are mechanisms by which the seller is responsible for the quality of products or services. A warranty is a voluntary benefit offered by the seller, typically covering manufacturing defects or other deficiencies, and may last, for example, two years. It does not limit the customer’s legal rights.
Defect liability is based on law and covers especially hidden defects that were present at the time of delivery. This legal liability can extend up to 10 years, and the consumer must report the defect within a reasonable time after noticing it.

Burden of proof for defects

During the warranty period, MHC Construction is responsible for ensuring that the product meets the promised quality. If a defect appears, it is presumed to fall under the warranty, unless the company proves otherwise.
Under legal defect liability, the consumer is usually required to prove that the defect is the seller’s responsibility. However, if the defect arises within six months of delivery, it is assumed to have existed at the time of delivery unless the seller can prove otherwise.
The warranty is a voluntary additional protection, while defect liability is a statutory right. Both offer consumer protection in different ways — and understanding the distinction between them is essential.
